The EU’s chief Brexit negotiator has warned that Brussels won’t give in to threats and blackmail, because the livid row over the Northern Irish border took a step nearer in the direction of sparking a commerce warfare.

Maros Sefcovic in impact accused Boris Johnson of mendacity concerning the penalties of EU withdrawal, declaring that it was time for “honesty” concerning the issues created by the type of onerous Brexit chosen by the UK authorities.

Insisting that the 27-nation bloc was united in rejecting British calls for to rewrite the controversial Northern Eire protocol, he despatched a stark message to London: “We within the EU by no means work with threats, we by no means work with blackmail, we attempt to work with constructive engagement and that’s what I’m pleading for.”

The European Fee vice-president was talking after international secretary Liz Truss informed him that Britain would have “no alternative” however to take unilateral motion until Brussels submitted to its demand for contemporary concessions on the protocol, which has successfully created a customs border between Northern Eire and the British mainland.

Her feedback in crunch cellphone talks with Mr Sefcovic set the scene for the publication inside days of laws to override the protocol, which was signed by Mr Johnson in 2020 with the intention of conserving the Irish border open after Brexit.

Voicing her “remorse” on the EU’s rejection of British calls for to revise Mr Sefcovic’s negotiating mandate, the international secretary stated that “if the EU wouldn’t present the requisite flexibility to assist clear up these points, then as a accountable authorities we might don’t have any alternative however to behave”.

Her ultimatum got here hours after lawyer common Suella Braverman revealed she had obtained authorized recommendation that it could be lawful to tear up elements of the protocol due to the “disproportionate and unreasonable” manner through which the UK believes it has been applied by Brussels.

Downing Road acknowledged that the scenario was “very critical” however insisted that no resolution on motion had but been taken. Talks are understood to be persevering with at an official stage over the approaching days.

However Mr Sefcovic stated the “probability” was now that the UK authorities would produce a brand new model of the Inner Market Invoice, which provoked a deep rift between London and Brussels in 2020 after ministers admitted its provisions to raise customs checks would breach worldwide regulation.

And a senior Downing Road supply stated that the cupboard was united across the place that “one thing must be executed” because the EU place gave the impression to be hardening.

“You by no means know what the EU are going to come back again with,” stated the supply. “However they set their place out in the present day, and we don’t have any indicators that that’s going to alter.”

Mr Johnson himself indicated that the federal government felt impelled to behave by the refusal of the unionist DUP to enter right into a power-sharing administration with Sinn Fein as long as the protocol stays in its present type – a scenario he urged was placing the Good Friday Settlement in danger.

“It’s clear that the unionist group received’t settle for the protocol,” stated the prime minister. “That’s apparent from what’s occurred. We’ve bought to repair it.”

Any unilateral breach of the protocol by the UK may finally result in a commerce warfare with Europe, permitting Brussels to droop all or a part of the zero-tariff commerce deal signed in 2020.

The previous head of the federal government authorized division, Sir Jonathan Jones QC, who give up over the Inner Market Invoice, warned that introducing the mandatory laws to override the protocol could be “critically problematic”.

“It seems like a rerun of what occurred two years in the past when the federal government was proposing to interrupt worldwide regulation,” he stated.

“We all know that the EU will probably be very cross if that occurs, and I feel it’s comprehensible that they might be cross, as a result of this is able to be a unilateral act, and it could very severely injury the connection we’ll proceed to want with the EU post-Brexit.”

However laws may take so long as a 12 months to undergo parliament, with stiff opposition anticipated within the Home of Lords, and authorities sources made clear that negotiations may proceed all through that point to attempt to avert a massively costly breakdown in commerce relations.

Mr Sefcovic expressed “critical concern” over the deadlock, warning it could be “unacceptable” for the UK to stroll away from the worldwide treaty signed by Mr Johnson.

He warned that the ambitions set out by the PM in Tuesday’s Queen’s Speech for additional UK divergence from EU requirements and rules would result in “extra problems, extra difficulties, extra checks” on items crossing the border.

Decrying a scarcity of “political will” on the British aspect to interact with proposed options to the commerce disruption, the fee vice-president stated: “Honesty about what the UK signed as much as is required. Honesty that the EU can’t clear up all the issues created by Brexit and the kind of Brexit chosen by the UK.

“We won’t renegotiate the protocol, and the EU is united on this place. Unilateral motion successfully disapplying the protocol will not be the answer.”

After being briefed by Mr Sefcovic on his talks with Ms Truss, Irish international minister Simon Coveney stated Dublin was in settlement with the rejection of “UK authorities threats of unilateral motion and breach of worldwide regulation”.

“The best way ahead is partnership, dialogue and real negotiation, not threats and elevating stress,” stated Mr Coveney.

Ms Truss ratcheted up tensions over the protocol on Tuesday, with an announcement warning that proposals set out by the EU to ease the friction in commerce would the truth is “take us backwards”.

However Mr Sefcovic informed her on Thursday that there was “no room” for additional concessions or for a change in his negotiating mandate, which should be agreed by all 27 EU member states.

Ms Truss stated that the protocol was inflicting “unacceptable disruption to commerce” and had created “a two-tier system the place folks in Northern Eire weren’t being handled the identical as everybody else within the UK”.

Calling for “extra pragmatism” from the fee, she stated that the problems could possibly be resolved, whereas nonetheless defending the EU single market, by implementing UK proposals for items destined for Northern Eire to be despatched by way of a light-touch “inexperienced channel” at customs, with shut checks reserved for these heading to the Republic.

However Mr Sefcovic stated that taking unilateral motion to disapply a world treaty would undermine belief between the EU and the UK, and that it could compromise efforts to guard the Good Friday Settlement.

“The EU and the UK are companions dealing with the identical international challenges, the place upholding the rule of regulation and dwelling as much as worldwide obligations is a necessity,” he stated. “Working aspect by aspect in a constructive method is of utmost significance.”
